Talking Infrastructure and Energy Seminar, Discussing recent regulatory developments in Indonesia

Focusing on recent developments (and some helpful reminders) of importance for investors, developers, lenders and contractors, both legal and commercial, Talking Infrastructure and Energy is hosted by Herbert Smith Freehills specialists and other guest speakers. The aim is to make the sessions interactive and informative, offering quality thought leadership and networking opportunities.

On 28 February, the seminar was hosted by David Clinch, HSF partner in the energy, infrastructure and mining groups in Asia, who introduced a panel of experts discussing recent regulatory developments in Indonesia, including: 

  • Government Regulation No. 1 of 2019, which regulates the arrangements for the deposit and use of proceeds from the export of natural resources from Indonesia; and 
  • MEMR Regulation No. 42 of 2018 (Regulation 42), which seeks to prioritize local crude production over imported crude oil and requires upstream oil and gas contractors to first offer their local crude production to Pertamina in Indonesia prior to any export of crude production. 

 The panel discussed the potential impact of these regulations on the Indonesian energy and resources industry, including for lenders and other financiers.
